By accessing or using VibeLevel.ai ("the Service"), operated by GPTSocial LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

VibeLevel.ai, operated by GPTSocial LLC, provides AI-native skills assessment services including:

✓Interactive coding and non-coding assessments with AI assistance
✓Multi-dimension AI collaboration scoring and analytics
✓Cloud-based IDE and artifact creation environment
✓Hiring assessment management and candidate evaluation

3. User Accounts and Registration

•You may use the Service as a guest or create an account
•You are responsible for maintaining the confidentiality of your account credentials
•You must provide accurate and complete information when creating an account
•You are responsible for all activities that occur under your account
•You must notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree NOT to use the Service to:

✗Violate any applicable laws or regulations
✗Harass, abuse, or harm others
✗Generate or distribute illegal, harmful, or offensive content
✗Attempt to gain unauthorized access to the Service or other users' accounts
✗Interfere with or disrupt the Service or servers
✗Copy, reverse engineer, decompile or otherwise exploit the Service
✗Use any AI-enabled features in a way that infringes third party rights
✗Transmit viruses, malware, or other harmful code

5. Content and Intellectual Property

You retain ownership of content you create using the Service.

License to Us

You grant us a limited license to store and display your content as necessary to provide the Service

Our Content

The Service, its original content, features, and functionality are owned by GPTSocial LLC and protected by applicable intellectual property laws

AI-Generated Content

Content generated by AI is provided as-is without warranties of accuracy or completeness

6. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

When you make a purchase, your payment data is processed by our authorized payment partner, Paddle.com, in accordance with their Privacy Notice.

7. Payment, Subscriptions and Billing

Payment Processing

All payments for the Service are processed by Paddle.com, which acts as our authorized reseller and Merchant of Record. When you purchase a subscription, you are purchasing from Paddle, and Paddle's Buyer Terms apply to all transactions in addition to these Terms.

Subscriptions

Paid subscriptions automatically renew for further periods equal to your initial subscription term until you cancel. By subscribing, you authorize Paddle to charge your payment method for recurring subscription fees on an ongoing basis. If a subscription offers a free trial, you must cancel before the trial ends to avoid being charged.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will not be charged again after that. You can cancel through the subscription management link in your confirmation email or by contacting us at contact@vibelevel.ai.

Price Changes

We may change subscription pricing with reasonable advance notice. You will be notified before any price increase takes effect. If you do not accept a price increase, you may cancel your subscription before the new price applies.

Taxes

Paddle handles the calculation and collection of applicable sales taxes (including VAT, GST, and similar consumption taxes) based on your location. Tax amounts will be shown during checkout.

8. Refunds and Withdrawal Rights

Refund requests are handled by our payment partner, Paddle.com. To request a refund, please contact Paddle through the link in your purchase confirmation email, or contact us at contact@vibelevel.ai and we will assist you.

EU/EEA and UK Consumers

If you are a consumer residing in the EU, EEA, or UK, you have the right to withdraw from your purchase for any reason within 14 days of completing a transaction, in accordance with Paddle's Refund Policy. You will receive a full refund of the charges paid, unless during that 14-day period you started using or benefiting from the Service after agreeing for it to be made available before the end of the withdrawal period.

All Other Regions

Refund eligibility is determined in accordance with Paddle's refund policy and applicable local consumer protection laws. We encourage you to contact us directly before raising a chargeback with your bank, as this often results in faster resolution.

Tax Refunds

Businesses charged sales tax (including VAT or GST) may be entitled to a refund of the tax amount if registered for that tax in the country of purchase. Contact Paddle within 60 days of your transaction date with a valid tax registration number.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11. Termination

•We may terminate or suspend your access if you materially breach these Terms, engage in fraud, or violate applicable law

•Upon termination, your right to use the Service will cease. You remain liable for any charges properly due up to the date of termination
•We may retain certain information as required by law or for legitimate business purposes

12. Modifications to Service and Terms

•We may update these Terms from time to time by notifying you via email or through the Service

•Updated terms take effect on the date specified in the notice or, if unspecified, 30 days after the notice

•If you do not agree with an update, you may cancel your subscription before the update takes effect

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of laws principles. If you are a resident of a U.S. state with mandatory consumer protection laws, those laws shall apply to the extent required.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GPTSOCIAL LLC EACH WAIVE THE RIGHTS TO (i) TRIAL BY JURY; AND (ii) PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING, IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

14. General Provisions

Entire Agreement

These Terms, together with Paddle's Buyer Terms and our Privacy Policy, constitute the entire agreement between you and us

Severability

If any provision is unenforceable, remaining provisions continue in full force

No Waiver

Our failure to enforce any right is not a waiver of that right

Assignment

You may not assign these Terms without our written consent. We may transfer our rights to affiliates or successors with notice

Electronic Notices

By using the Service, you consent to receive notices electronically (including by email)

Third Party Rights

These Terms are between you and us. No other party can enforce its terms
